Designed for professionals responsible for workforce decisions, this five-session certification focuses on the judgment behind compliant HR work. It shows how to evaluate the facts, follow consistent procedures, and reduce risk when the correct response is not immediately clear.

Outline

This five-session certification covers the HR decisions most likely to create legal and financial risk. Learn how to improve hiring, manage FMLA and ADA issues, investigate complaints, prevent wage and hour errors, document performance concerns, and prepare for termination.

Session 1: Build a Compliant Hiring and Classification Process

  • Job descriptions that reflect the position's actual duties and requirements
  • Structured interviews and consistent questions for every candidate
  • Interview topics and practices that may create legal concerns
  • Clear offer letters and appropriate at-will employment language
  • Fair Credit Reporting Act requirements for background reports
  • Exempt and non-exempt classifications under the FLSA
  • Hiring records that support consistent employment decisions

Session 2: Manage FMLA Leave and ADA Accommodation Requests

  • Employer and employee responsibilities under the FMLA and ADA
  • Employee eligibility, available leave, and reinstatement rights
  • Medical certifications and confidential employee information
  • Intermittent leave and reduced-schedule requests
  • The ADA interactive process and reasonable accommodation review
  • Coordination among the FMLA, ADA, and workers' compensation
  • Documentation and communication throughout the leave process

Session 3: Respond to Harassment Complaints and Conduct Investigations

  • Anti-harassment policies and employee reporting procedures
  • Manager responsibilities after receiving a workplace complaint
  • Investigation scope, timing, and investigator selection
  • Interviews with the complainant, respondent, and witnesses
  • Credibility reviews and conflicting information
  • Confidentiality and investigation documentation
  • Corrective action and the Faragher-Ellerth defense

Session 4: Prevent Wage and Hour Classification and Pay Errors

  • Employee classification and common misclassification problems
  • Exempt and non-exempt requirements under the FLSA
  • Work activities that must be treated as compensable time
  • Accurate timekeeping and overtime calculations
  • Work completed before or after scheduled hours
  • Travel time, training time, and related pay requirements
  • Rules affecting interns, volunteers, and student workers

Session 5: Document Performance, Apply Discipline, and Prepare for Termination

  • Clear performance expectations and measurable improvement requirements
  • Objective documentation based on specific facts and events
  • Direct feedback that explains what must change
  • Performance improvement plans and progressive discipline
  • Consistent treatment across similar employee situations
  • Documentation and procedures supporting termination decisions

Credits

  • This program has been approved for 7.5 general recertification credit hours toward PHR, SPHR, and GPHR recertification through the HR Certification Institute.
  • This program is valid for 7.5 PDCs for the SHRM-CP or SHRM-SCP.

Certifications

A comprehensive online exam will be administered at the end of the course to assess your knowledge and understanding of principles and practices. The exam must be completed within 60 days of the last live event or the date of on-demand purchase. A paid extension may be requested for a maximum completion window of 120 days, after which the exam window closes.

Certification: Upon successful completion of the final exam (with a score of 80% or higher) and meeting the attendance requirements, you will receive a digital credential, validating your expertise and commitment to advancing your career.

Michele has over 20 years of progressive human resources management, safety program development, and workforce risk mitigation experience spanning construction, education, government, healthcare, manufacturing, non-profit, and senior living industries. She started Mathews’ HR & Safety Consulting Services after having an increase of business owners reaching out for guidance and assistance due to the recognition she was receiving regionally for her procedures and training. Michele is an OSHA Authorized Trainer and has both the Professional Human Resources (PHR) and Society for Human Resources Management Certified Professional (SHRM-CP) designations.
